1. Introduction
ApnaTube ("we," "our," or "us") respects the intellectual property rights of others and expects users to do the same. This Copyright Policy explains how copyright infringement claims are handled on ApnaTube in accordance with applicable Indian law, including the Copyright Act, 1957, and international standards.
Uploading, sharing, or distributing copyrighted material without the necessary permissions or licenses is strictly prohibited on ApnaTube.
2. User Responsibility
Users are solely responsible for content they upload or share. By uploading content (video, audio, thumbnail, description, etc.) you represent and warrant that:
- You own the content or have obtained all necessary rights, licenses, and permissions.
- Your upload does not infringe the intellectual property rights of any third party.
3. Copyright Infringement Notice
If you believe your copyrighted work has been uploaded to ApnaTube without authorization, submit a Copyright Infringement Notice. A valid notice must include:
- Your full name, email address, and physical address.
- Identification of the copyrighted work claimed to have been infringed.
- The exact URL(s) or location of the infringing content on ApnaTube.
- A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information provided is accurate and that you are the owner or authorized to act on behalf of the owner.
- Your physical or electronic signature (typed name is acceptable when sent from the email address on file).

4. Counter-Notification
If your content was removed due to a copyright claim and you believe the removal was a mistake or qualifies as fair use, you may file a counter-notification. A valid counter-notification must include:
- Your full name, address, and contact information.
- Identification of the removed content and its previous URL.
- A statement under penalty of perjury that you have a good faith belief the material was removed in error.
- Consent to jurisdiction of courts located in Hanumangarh, Rajasthan, India.
- Your electronic or physical signature.
Upon receipt of a valid counter-notification, we may restore the content unless the original claimant files a court action within 10 business days.
5. Repeat Infringer Policy
ApnaTube enforces a strict policy against repeat infringement. Accounts that repeatedly violate copyrights may be suspended or terminated. We may also remove any content that appears to infringe copyrights without waiting for formal notice.
6. Fair Use & Licensed Material
ApnaTube recognizes the concept of "fair use" (or fair dealing) where limited use of copyrighted material for commentary, criticism, news reporting, teaching, or research may be permissible. Fair use determinations depend on facts and circumstances; users should seek legal advice if unsure.
If you have a license, partnership, or other authorization allowing use of copyrighted material, keep documentation and provide proper attribution when required.
7. Monetization & Partner Content
ApnaTube partners with creators, studios, and music labels. Uploading third-party copyrighted material without authorization may result in:
- Removal of monetization or revenue withholding.
- Legal action by rights holders.
- Termination of the creator account.
8. Automated Copyright Detection
We use automated systems to detect copyrighted content. These systems match uploads against partner databases and may block or restrict content before publication. If your content is flagged incorrectly, you may dispute the decision via the Creator Dashboard appeal process.
9. Legal Consequences
Unauthorized uploading, distribution, or reproduction of copyrighted works may result in civil or criminal penalties under the Indian Copyright Act, 1957, monetary damages, or account suspension.
